1. Scope

These Terms of Use govern your access to and use of https://batt-scan.com and any related pages we operate (the “Site”). They apply to everyone who visits the Site, whether or not you transact business with us.


By accessing or using the Site, you agree to these Terms of Use. If you do not agree, do not use the Site.

2. Who We Are

he BATTSCAN Site is operated by Future Tech Auto, LLC, a Nevada limited liability company with its principal place of business at 2511 Eagles Nest Ct, Midlothian, Texas 76065, trading as EVPro+ (“we,” “us,” or “the Company”). When purchasing a BATTSCAN Package online your receipt and card statement may show the name FutureTech or EVPRO+.

3. Relationship to the Product Terms

Purchases, subscriptions, hardware, the BATTSCAN application, testing, reports, returns, warranty, and technical support are governed by the BATTSCAN Terms and Conditions of Purchase and Use (the “Product Terms”), not by these Website Terms of Use.

 

Where both documents may address the same subjects, the Product Terms control anything relating to a purchase, a subscription, or use of the application. These Terms of Use control anything relating to the BATTSCAN Website itself.

4. Eligibility

You must be at least 18 years old to use the products and services of the Website. The Site is intended for automotive service professionals, fleet operators, vehicle inspectors, and other professionals interested in or working with hybrid and electric vehicle service.

5. Permitted Use

We grant you a limited, revocable, non-exclusive license to access and view the website content for your own business or personal informational purposes. You may print or download individual pages for internal reference.

6. Prohibited Conduct

You may not:

  • Scrape, harvest, crawl, or systematically copy the Site or any part of it, including the supported vehicle list, whether manually or by automated means
  • Republish, resell, or redistribute Site content, or present it as your own
  • Probe, scan, or test the security of the Site, or attempt to gain unauthorized access to any account, server, or system
  • Interfere with the operation of the Site, including by overloading it or introducing malicious code
  • Use the Site to develop or assist in developing a competing product or service
  • Misrepresent your identity or affiliation, or impersonate anyone
  • Use the Site for any unlawful purpose or in violation of these Terms of Use7. Site Content and Intellectual Property

7. Site Content and Intellectual Property

The Site and its content — including text, graphics, the BATTSCAN name and logo, the supported vehicle list, documentation, videos, and the arrangement of all of it — are owned by us and are protected by intellectual property laws. Nothing on the Site grants you any license to use our name, logo, or other content.

8. Vehicle Compatibility Information

The Site publishes a list of vehicles BATTSCAN supports. That list reflects vehicles that have completed all of our validation processes as of the date you are viewing the content; there will be changes over time as coverage is added or withdrawn.

 

Compatibility information is provided for reference. We do not guarantee that any particular vehicle is or will remain supported, and appearance on the list is not a representation that BATTSCAN will produce a particular result on a given vehicle. Purchasing decisions made on the basis of the list are your own.

9. Educational and Technical Content

The Site may publish training content, how-to videos, technical explanations, and guidance on hybrid and EV battery service. This material is general information, not vehicle-specific service instruction.

 

Website Content does not replace manufacturer service information, applicable safety procedures, or your own professional judgment. High-voltage battery work carries real risk of injury, and you are responsible for working within training and experience you have acquired over time and following proper procedure(s).

 

10. Accounts and the Reporting Portal

To access member areas of the Site it requires you to have an account. Account creation, credentials, permitted users, device registration, and access to reports are governed by the Product Terms not the website terms. You are responsible for keeping your credentials confidential and for all activity under your registered account.

11. Purchasing Through the Site

BATTSCAN may be purchased directly through the Site or any other links in marketing and social media activities. Prices, package contents, subscription terms, expiration and renewal, warranty, and support are governed by the Product Terms, which are presented to you before you complete a purchase.

 

The purchase price includes the dongle (OBD connector) and the first year a licensed software Subscription. Subscriptions are not renewed automatically, and we do not store your payment method for future charges; continuing after the first year requires a renewal you choose to purchase, currently $549 per year per dongle.

 

Our commitment is that BATTSCAN will perform as designed and as described. If something is not working, contact us first and give us the opportunity to ensure all works properly for you. An unopened package may be returned within 30 days of delivery, less a 15% restocking fee covering payment processing and other related order processing costs. Once a package has been opened or an account activated, returns are limited to the defective dongle ID# assigned to your account. Subscriptions are non-refundable once activated, and training subscriptions are non-refundable once accessed. Full terms are in the Product Terms.

12. Submissions and Feedback

If you send us feedback, suggestions, ideas, or other information related to BATTSCAN, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or obligation to you. We treat feedback as non-confidential unless we agree otherwise in writing.

 

Do not send us personal information about your customers, vehicle owner details, or anything confidential through general Site forms or email.

13. Third-Party Links and Services

The Site may link to third-party sites or services we do not control. We are not responsible for their content, practices, or privacy policies, and a link is not an endorsement. Your dealings with third parties are between you and them.

14. Privacy

Our collection and use of personal information through the Site is described in our Privacy Policy at https://batt-scan.com/privacy, which is incorporated into these Terms of Use.

15. Availability and Changes

We may change, suspend, or discontinue any part of the Site at any time, and we do not guarantee that it will be available without interruption. We may impose limits on certain features or restrict access without notice.

16. Errors, Inaccuracies, and Omissions

We work to keep the Site accurate and current, but content may contain typographical errors, inaccuracies, or omissions. This includes product descriptions, pricing, promotions, shipping charges, delivery estimates, availability, and vehicle compatibility.

 

We may correct any error, inaccuracy, or omission, and may change or update information at any time without prior notice. Where an order has been placed on the basis of inaccurate information, including inaccurate pricing, we may cancel that order after it has been submitted. If we do, we refund the amount charged in full.

 

Except where the law requires it, we have no obligation to update, amend, or clarify information on the Site. Information shown on a page, including the supported vehicle list, indicates the most current information available at that time.
Where Site content conflicts with the Product Terms or a written quote, the Product Terms or quote controls.

17. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

 

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ITS CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

 

SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE EXCLUSIONS ABOVE MAY NOT APPLY TO YOU. THIS GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.

18.  Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption arising from your use of or inability to use the Site.

 

Our total aggregate liability arising out of or relating to the Site will not exceed [$100] or the amount you paid us for access to the Site, whichever is greater. This limit does not apply to amounts owed under the Product Terms, which have their own limit.

 

Nothing in these Terms of Use limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

19. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms of Use, or your violation of any law or third-party right.

20. Governing Law and Disputes

These Terms of Use are governed by the laws of the State of Texas, without regard to its conflict of laws rules.

 

If you have a concern or dispute, contact us at support@batt-scan.com first, please provide us 30 days to resolve the matter to our mutual satisfaction before starting formal legal action.

 

Any dispute arising out of or relating to these Terms of Use or to the Site will be brought exclusively in the state or federal courts located in Dallas County, Texas. Both parties consent to the personal jurisdiction of those courts and waive any objection based on venue or forum.

 

Nothing in this section prevents either party from bringing a qualifying individual claim in small claims court in Dallas County, Texas. TO THE EXTENT PERMITTED BY LAW, BOTH PARTIES WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY ACTION ARISING OUT OF OR RELATING TO THESE TERMS OF USE.

21. Changes to These Terms

We may revise these Terms of Use at any time. The revised version takes effect when posted with a new revision number, and for material changes we will make reasonable efforts to give at least 30 days’ notice. Continuing to use the Site after that means you accept the revision.

22. General

  • Entire agreement. These Terms of Use, the Privacy Policy, and, for customers, the Product Terms are the entire agreement regarding your use of the Site.
  • Severability. If any provision is unenforceable, it is limited or removed to the minimum extent necessary and the rest remains in effect.
  • No waiver. Failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign these Terms of Use. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Export and sanctions. You represent that you are not located in an embargoed country and are not on any U.S. government restricted-party list.
  • Language. If these Terms of Use are translated, the English version controls.
