Terms and Conditions of Purchase and Use

1.  Agreement to These Terms

These Terms and Conditions (“Terms”) govern your purchase and use of the BATTSCAN battery diagnostic platform, including the BATTSCAN application, the OBD hardware device ID3, and any other hardware supplied, your user account, the reporting portal, and any related documentation or support services (together, “BATTSCAN” or the “Service”).

BATTSCAN is distributed by FutureTech Auto, LLC, a Nevada limited liability company with its principal place of business at 2511 Eagles Nest Ct, Midlothian, Texas 76065, trading as EVPro+ (“we,” “us,” or “the Company”).
Your receipt and card statement may show the name EVPRO+, which is the trading name of the same company.

By placing an order, activating an account, or using BATTSCAN in any way, you agree to these Terms. If you do not agree, do not purchase or use BATTSCAN.

If you are entering into these Terms on behalf of a business, you represent that you have authority to bind that business, and “you” refers to that business.

2.  Definitions

  • Application — the BATTSCAN software application installed on a compatible device.
  • Dongle — the BATTSCAN OBD dongle that connects the vehicle’s diagnostic port to the Application.
  • Device — a tablet or phone running the Application, registered to your account.
  • Registered Account — the email address to which a Device and its licence are registered at purchase.
  • Subscription — the paid, time-limited right to access the Application and reporting portal on a registered Device.
  • Test — a single completed or attempted battery state-of-health evaluation performed using BATTSCAN.
  • Report — the battery health output generated by BATTSCAN following a Test.
  • Supported Vehicle — a vehicle year, make, and model appearing on the current published BATTSCAN compatibility list.

3.  Accounts and Licensing

3.1  Eligibility

You must be at least 18 years old to create an account. BATTSCAN is intended for use by automotive service professionals, fleet operators, vehicle inspectors, and others who are competent to work safely on hybrid and electric vehicles.

3.2  How Licensing Works

Each Dongle ID# is registered to a single email address at the time of purchase. That registration carries the license for using the BATTSCAN dongle ID# registered to its usage Subscription.

More than one person at your business may use a registered Dongle ID# and its login. This is intended for a business or facility using one set of credentials rather than an account for every technician. Accordingly:

  • You may allow employees and authorized personnel of the business or location to use the Dongle ID# registered to your Account
  • You may not share credentials with anyone outside the registered business or location, or with another business
  • The account holder is responsible for everything done under the Registered Account, including all Tests performed, all Reports generated, and compliance with the safety requirements in Section 9.

Fleet operators and multi-shop operators may purchase multiple Devices under a custom quote. Where a custom quote applies, its Device count and any additional terms govern the usage of the business license.

3.3  Account Security

You are responsible for keeping your BATTSCAN credentials confidential within your business and for all activity under the Registered Account including the Hardware/Dongle ID#. Notify us promptly at support@batt-scan.com if you believe your account has been accessed by someone outside your business.

3.4  Accurate Information

You agree to provide accurate account, billing, and business information and to keep this information current. We may exercise our right to suspend an account with materially inaccurate information and usage.

4.  Purchase Terms

4.1  Orders and Sales Channel

BATTSCAN is sold through its authorized distribution network. All orders and offers to purchase are subject to our acceptance. We may decline to accept or cancel any order, including after it has been submitted, for any reason including, but not limited to; suspected fraud, typographical errors in pricing or product descriptions, and product unavailability. If we cancel an order you have already paid for, we will refund the full amount charged on the credit card.

Your order is accepted, and our agreement formed when we send you a final order confirmation with shipment tracking information. A payment receipt from our merchant processor confirms that your paid order is received online; this by itself is NOT acceptance of your order and subsequent shipment.

4.2  Pricing and Taxes

Prices are stated in U.S. dollars and exclude sales tax, shipping, and any duties, which are added at checkout or invoiced separately where applicable. Pricing is subject to change at any time, but a change does not affect a paid order we have already accepted.

4.3  Payment

Payment is due at the time of purchase unless a purchase order is issued and we have agreed to invoice and it’s payment terms in writing. You authorize us to charge your payment method for the purchase price, applicable taxes, and shipping. Payments are handled by third-party payment processors. We do not receive or store your full card details, and we do not retain a payment method for future charges.

4.4  Shipping and Risk of Loss

Shipping cost estimates are not guaranteed as we do not control transportation costs incurred by 3rd party logistics providers. Title and risk of loss for hardware and any other devices shipped pass to you when the shipment is delivered to the address on your account.

4.5  Packages

What you receive depends on the package purchased, as described at the time of sale. The first-year purchase price includes the hardware (dongle) and the first year of the Software Subscription. Additional years are renewed separately, at your choice, at the rate in Section 5.4. License Renewal reminders will be sent to you prior to the license expiration date.

Package

First-year price

Includes

Nightwatch

$775/USD

Dongle, licence, HV safety and PPE training. No tablet.

Eclipse

$895/USD

Dongle, licence, Android tablet, EV Safety Series training.

Shadowscan

$925/USD

Dongle, licence, Android tablet, EV Safety Series plus NiMH training.

Nightfall

$995/USD

Dongle, licence, Android tablet, EV Safety Series plus 22-Module training.

The purchase price covers the hardware and the first year of Subscription; taxes and shipping costs are additional. Continuing to use BATTSCAN after the first year requires a software license renewal, currently at $549 per year / per License supporting your Dongle ID#.

4.6  Training and Educational Content

Packages include access to online training courses and content that are delivered through EV OnDemand Platform. The content included depends on the BATTSCAN package purchased, as listed in Section 4.5.

Training access begins when you activate your account and runs for one year, matching your Subscription term.

Training access is included with your initial purchase and covers up to five users. Larger teams can be accommodated under a custom quote. Renewing your Subscription does not include further training access.

Each completed module produces a certificate you can print and download. Your EV OnDemand welcome email explains how to access and save them; keep your certificates as you earn them, since they are no longer available through the platform once your access ends.

5.  Subscription Term, Expiration, and Renewal

5.1  Subscription Term

Access to the Application and reporting portal requires an active Subscription. The first year of Subscription is included in the initial package purchase price and begins on activation. Subscriptions run on an annual term.

5.2  No Automatic Renewal

Your Subscription does not renew automatically. We will not charge your payment method at the end of an annual term, and we do not keep your card on file for that purpose. Your Subscription simply expires at the end of its term unless you choose to renew it.

Because there is no recurring charge, there is nothing to cancel. If you do not want to continue, take no action and the Subscription will end on its expiration date.

5.3 Renewal Reminders

As a convenience, we will send reminders to the email address on your Registered Account at approximately 30 days, 14 days, 7 days, and 1 day before your Subscription expires. Each reminder will state the expiration date, the annual subscription renewal price, and will include a direct link to renew your subscription.

On the expiration date we will send one final notice by email, confirming that your Subscription has expired and how to renew.

Keeping the email address on your account current is your responsibility. Failure to receive a reminder does not extend your Subscription term and does not oblige us to reinstate an expired Subscription or to restore data past the retention period in Section 5.5.

5.4  How to Renew

You may renew from within your account, or by contacting support@batt-scan.com, at any time before your Subscription expires. The current annual renewal rate is $549 per year per Dongle ID# and its License.

Renewal rates may change. The rate in effect when you renew is the rate that applies; we will not change the price of a renewal you have already purchased.

5.5  What Happens at Expiration

When your Subscription expires, access continues for a further 14 days as a grace period. This is so that testing is not interrupted during the optional renewal process — for example, where the person who authorizes payment is not immediately available to initiate the renewal.

At the end of the grace period the BATTSCAN application stops running Tests and access to the reporting portal expires. The dongle and if you purchased a package that included the Android Tablet (device) remain as your ownership, but running a BATTSCAN Diagnostic Test requires an active Subscription.

We recommend downloading and saving any Reports you need for your service records before your expiration date to ensure your records are up to date.

5.6  Renewing After Expiration

You may renew after your Subscription has expired. If you renew within 180 days of the expiration date, your account and your Report history are restored in full.

After 180 days, your account and any stored Reports may be permanently deleted and not recoverable. Renewing after 180 days could mean starting a new account with no prior Report history.

6. Our Commitment, Returns, and Refunds

6.1  Our Commitment

Our commitment is that BATTSCAN Diagnostic Testing will perform as designed and as described. If the testing process is not working as it should, contact us at support@batt-scan.com and please give us the opportunity to resolve. Most issues are resolved quickly through support, a software update, or a replacement dongle.

If we cannot resolve the testing application, the return and refund terms below apply.

6.2  Hardware Returns

Unopened packages may be returned within 30 days of delivery and will incur the restocking fee described below. To qualify, the package must be unopened and in its original sealed packaging, the Dongle must never have been connected to a vehicle, and if you purchased a package with an Android Tablet and/or training access these must not have been opened or activated.

Once a package has been opened or an account activated, any hardware is no longer returnable for change of mind. A Dongle that has been connected to a vehicle cannot be resold as new. After that point, returns are limited to hardware that is defective (and you will be provided with a replacement), refer to Section 7.

To start a return, contact support@batt-scan.com for a return authorization; returns sent without one may be refused. Return shipping cost is the purchaser’s responsibility. A restocking fee of 15% of the original purchase price applies to unopened returns, to cover the payment processing costs, shipping and packaging costs of the original sale and shipment. Refund is issued once return is received and inspected and BATTSCAN Team.

If a shipment arrives damaged or incomplete, report it including photo of original shipment box and its contents within 14 days of delivery (Ref Section 4.4) and we will work with you on any replacement needed or sending missing product(s) as necessary.

6.3  Subscription Refunds

Subscription fees are not refundable once your Subscription has been activated. Where an unopened and used package and its contents are returned under the terms of Section 6.2, the Subscription will be deactivated, and the package price will be refunded less the applicable restocking fee.

6.4  OnDemand Training

If your package includes OnDemand EV Training access, it will be non-refundable once you have accessed the training content.

6.5  Defective Dongle

A Dongle that fails within the warranty period is covered by the limited warranty in Section 7 rather than by this section. We repair, replace, or a prorated refund at our option; if return shipping costs are due to a warranty claim these costs are at our expense, and no restocking fee applies.

6.6  How Refunds Are Issued

Where a refund is due — under the warranty, change of mind for unopened package, or we cancelled your order — refund is issued on the original payment method after receipt and inspection of the package return, most refunds are processed within 10 business days on our end, and funds to your account are subject to your credit card providers terms.

7.  Limited Dongle Warranty

We warrant that the OBD dongle will be free from defects in materials and workmanship under normal use and proper care including storage for one (1) year from the date of delivery.

Any tablet device supplied with a BATTSCAN package is covered by the tablet manufacturer’s own warranty, not by us. Warranty claims on a tablet should be directed to that manufacturer.

If a covered defect appears in the Dongle during the warranty period, we will, at our option, repair the item, replace it with a functionally equivalent unit, or refund at a prorated value of the original purchase price. This is your exclusive remedy under this warranty.

This warranty does not cover:

  • Damage from accident, abuse, misuse, liquid, fire, or unusual physical or electrical stress
  • Damage from use with vehicles or equipment other than as documented
  • Cosmetic wear, including scratches and dents
  • Items opened, modified, or repaired by anyone other than us or our authorized service provider
  • Any product from which the serial number or identifying label has been removed or defaced

8.  Technical Support

8.1  What Support Covers

An active BATTSCAN Subscription includes technical support for:

  • Account activation, login, and subscription questions
  • Application installation, updates, and connection of your device to the OBD dongle
  • Questions about the voice guided test procedure and pre-test requirements
  • Interpretation of a Report’s result indicators
  • Suspected hardware faults and warranty claims
  • Vehicle compatibility questions
8.2 What Support Does Not Cover

Support does not include:

  • Diagnosing or repairing the vehicle itself, or recommending a specific repair
  • Interpreting data from other tools or scan tool equipment
  • Support for vehicles that are not Supported Vehicles in BATTSCAN
  • Issues caused by modified, rooted, or unsupported devices, or by hardware we did not supply
  • Network, cellular, or Wi-Fi connectivity problems on your side
  • Training on Hybrid or EV services generally, beyond the use of BATTSCAN
8.3  How to Reach Support

Submit a support request from within your BATTSCAN user account, or email support@batt-scan.com. To help us resolve issues quickly, include the vehicle year, make, and model; the test date; a description of what happened; and screenshots or screen recordings where available (this assists our ability to provide support quickly eliminating going back and forth to secure basic information).

8.4  Hours and Response Targets

You may submit a support request at any time, 24 hours a day. Our support team responds during business hours, Monday through Friday, 7:00 a.m. to 4:00 p.m. Mountain Time, excluding U.S. federal holidays. Observed holidays are listed on our support page.

We target a first response within 48 business hours. Response targets are goals, not guarantees, and do not create a service level agreement.

The chat feature in your customer dashboard is an automated assistant, not a live person. It can answer common questions at any hour and pass anything else to our team, who will respond during the hours above.

8.5  Your Cooperation

Resolving an issue often requires information only you can provide. If we request diagnostic information, test logs, or the return of hardware for inspection and you do not respond within 30 days, we may consider the matter resolved and close the support ticket.

9.  Safe Use and Testing Requirements

The BATTSCAN state-of-health test requires the vehicle to be driven under specific conditions, including full-throttle acceleration followed by shifting to neutral and braking to a complete stop. You are solely responsible for conducting all testing safely and lawfully.

During account setup you will be asked to review and accept the BATTSCAN safety acknowledgment. By running a Test, you further agree that you have read and will follow the Testing Tips, Test Instructions, and Best Practices in the user guide and app menu in their entirety, and specifically that you will:

  • Perform testing only on a safe, clear, straight, and flat road with adequate distance, and only where it will not endanger or obstruct other traffic
  • Obey all applicable traffic laws at all times
  • Ensure all occupants wear seat belts and that the vehicle’s braking system is in proper working order
  • Not perform BATTSCAN testing on the same vehicle more than twice within any 24-hour period
  • Allow the vehicle to rest a minimum of ten minutes before reattempting a test that failed or was terminated
  • Not view Test results while driving

You acknowledge that the test procedure places the high-voltage battery pack under load by design, that repeated testing may reduce battery pack service life, and that you assume responsibility for the decision to test any given vehicle.

Where a Registered Account is used by more than one person, the account holder is responsible for ensuring that everyone who performs a Test has read and follows these requirements.

10.  Vehicle Compatibility

BATTSCAN uses a validation-based approach: a vehicle is added to the supported list only after it has completed all testing, validation, and verification processes. The current supported vehicle list is published on our website and within the platform.

Coverage changes over time. We do not guarantee that any particular vehicle is or will remain supported, and we may add or remove vehicles from the supported list at our discretion. Running a Test on a vehicle that is not a Supported Vehicle will not produce a valid result, and we are not responsible for vehicle repair or service decisions made on the basis of such a result.

11.  Test Results and Professional Judgment

BATTSCAN is a diagnostic aid. Reports describe the observed behavior of a battery pack under a specific test, on a specific date, under specific conditions.

You acknowledge and agree that:

  • A Pass result is not a warranty, guarantee, or prediction that the battery will continue to perform, and does not mean the vehicle is free of defects
  • A Fail or Partial Fail result is an indication for further investigation, not a determination that a specific component must be replaced
  • Results must be evaluated alongside vehicle history, customer concerns, manufacturer service information, and other diagnostic data
  • All repair, replacement, purchase, sale, valuation, and safety decisions remain yours and rest on your own professional judgment
  • We are not responsible for the accuracy of any representation you make to a third party, including a customer or a vehicle buyer, based on any Report

If you provide a Report to a customer or third party, you do so on your own responsibility and you are responsible for how the result is characterized.

12.  Software License

Subject to these Terms and an active BATTSCAN Subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on each registered Dongle ID# you purchased for its intended purpose during your Subscription term. The Testing Application is licensed, not sold.

You may not:

  • Copy, modify, translate, or create derivative works of the Application
  • Reverse engineer, decompile, or disassemble the Application or the Dongle, or attempt to derive the underlying algorithms or test methodology, except to the extent this restriction is prohibited by law
  • Rent, lease, lend, sell, sublicense, or otherwise make BATTSCAN available to a third party as a service
  • Share credentials with anyone outside the business or location where the Dongle ID# is registered to
  • Install and use the Application on more Dongles than your Subscription covers, your dongle has a unique ID# registered to your account
  • Circumvent the guided test procedure, security features, or usage limits
  • Use BATTSCAN to build or assist in building a competing product

13.  Data and Privacy

Our collection and handling of personal information is described in our Privacy Policy at https://batt-scan.com/privacy, which is incorporated into these Terms.

Test data and Reports generated from your Tests are available to you.

You grant us the right to use any test data to operate the Service, improve the accuracy of the test results, and expand the range of vehicles we support.

If we publish or share findings drawn from test data, we do so only in aggregate form — grouped by make, model, and year, containing no VIN and nothing identifying you, your business, your customers, or an individual vehicles owner. We do not sell personal information.

14.  Intellectual Property

BATTSCAN, the BATTSCAN name and logo, the Application, the Dongle design, the test methodology, and all related documentation are owned by us and are protected by intellectual property laws. Nothing in these Terms transfers any ownership to you.

15.  Updates and Changes to the Service

We may release updates to the Application and may require you to install them to continue using BATTSCAN. We may modify, add, or discontinue features at any time. If we discontinue what we deem as a material feature during a paid Subscription term, we will provide notice and, where appropriate, a pro-rated refund may be issued if you elect to no longer use the BATTSCAN product.

16.  Suspension and Termination

We may suspend or terminate your account if you breach any of these Terms, failure to pay for product usage and licensing, use of BATTSCAN unlawfully or unsafely, or share credentials outside your business. Where practical and appropriate, we will give notice and provide you with an opportunity to cure.

On termination, your license ends immediately and you must stop using the Application. Sections that by their nature should survive — including payment obligations, disclaimers, limitation of liability, indemnification, and dispute resolution — survive termination.

17.  Disclaimer of Warranties

EXCEPT FOR THE LIMITED HARDWARE WARRANTY IN SECTION 7, BATTSCAN IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT BATTSCAN WILL BE UNINTERRUPTED OR ERROR-FREE, THAT EVERY RESULT WILL BE ACCURATE FOR EVERY VEHICLE IN EVERY CONDITION, OR THAT IT WILL DETECT EVERY BATTERY FAULT.

SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE EXCLUSIONS ABOVE MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.

18.  Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages and-or for lost profits, lost revenue, lost business, vehicle downtime, comeback costs, diminished vehicle value, or damage to a battery pack arising from testing performed in accordance with or contrary to the documented procedures.

Our total aggregate liability arising out of or relating to BATTSCAN will not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

19.  Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of BATTSCAN, your violation of these Terms or of any applicable law, your testing practices, or any representation you make to a third party based on a Report.

20.  Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules.

20.1  Informal Resolution First

If you have a concern or dispute, contact us at support@batt-scan.com first. We will work with you to resolve your concerns before any formal legal action is started, and we ask that you provide us 30 days to resolve the situation to our mutual satisfaction.

20.2  Jurisdiction and Venue

Any dispute arising out of or relating to these Terms or to BATTSCAN will be brought exclusively in the state or federal courts located in Dallas County, Texas. Both parties consent to the personal jurisdiction of those courts and waive any objection based on venue or forum.

20.3  Small Claims

Nothing in this section prevents either party from bringing a qualifying individual claim in small claims court in Dallas County, Texas.

20.4  Jury Trial Waiver

TO THE EXTENT PERMITTED BY LAW, BOTH PARTIES WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY ACTION ARISING OUT OF OR RELATING TO THESE TERMS.

21.  Changes to These Terms

We may update these Terms. We will post the revised version with a new revision number, for material changes, provide notice through the Application or by email. Continued use after the new revision number constitutes acceptance. If you do not accept the revised Terms, we recommend you stop using BATTSCAN.

22.  General

  • Entire agreement. These Terms, together with the Privacy Policy and any order documents or custom quote, are the entire agreement between us regarding BATTSCAN.
  • Severability. If any provision is held unenforceable, the rest remains in effect.
  • No waiver. Failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. Neither party is liable for delays caused by events beyond its reasonable control.
  • Notices. Legal notices to us should be sent to 2511 Eagles Nest Ct, Midlothian, TX 76065. We may send notices to the email address on your Registered Account.
